NORTH NOTARY – TERMS OF SERVICE

1. ACCEPTANCE OF TERMSBy accessing or using the services provided by North Notary (“we,” “us,” or “our”) through
northnotary.ca, you signify that you have read, understood, and agree to be bound by these Terms of Service. If you are using our services on behalf of a legal entity, you represent that you have the authority to bind that entity to these terms.
2. DESCRIPTION OF SERVICES
North Notary provides online and in-person notarial and commissioning services. We limit our services to verifying signatures, marks, and copies of documents to be true and genuine.
3. NO LAWYER-CLIENT RELATIONSHIP
North Notary is not a law firm and does not provide legal advice. Your use of this website and our services does not establish a lawyer-client or paralegal-client relationship. We do not review your documents for truthfulness, legality, or completeness. You should consult a lawyer for any legal opinions regarding the content of your documents.
4. REMOTE COMMISSIONING COMPLIANCE
Our online services comply with Ontario Regulation 431/20 (Administering Oath or Declaration Remotely) under the Commissioners for Taking Affidavits Act.
- Responsibility for Acceptance: It is your sole responsibility to ensure that the intended recipient (e.g., a court, bank, or foreign government) will accept a document commissioned or notarized remotely.
- Physical Presence: For certain documents like Wills and Powers of Attorney, “wet ink” signatures and specific virtual witnessing protocols apply.
5. USER OBLIGATIONS
- Identification: You must provide at least one piece of valid, government-issued photo ID (and a second piece if requested).
- Unsigned Documents: Do NOT sign your document before your appointment. You must sign in the presence of the Notary Public.
- Accuracy: You assume 100% responsibility for the accuracy and legality of the content provided in your documents.
6. CANCELLATION AND REFUND POLICY
- Cancellations: 100% refund if cancelled more than 48 hours before appointment. A 25% fee applies for cancellations within 48 hours.
- No-Shows: Failure to attend a scheduled appointment is non-refundable, though we may offer a one-time option to reschedule.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, North Notary is not liable for any indirect, incidental, or consequential damages. Total liability for any claim is strictly limited to the amount paid for the specific service rendered. There is no liability for rejections or the unenforceability of digital signatures by third parties.
8. PRIVACY AND DATA PROTECTION
Personal information is collected and processed in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA). Data is used solely for identity verification and the proper administration of notarial acts.
9. GOVERNING LAW
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ontario.
