The all-purpose affidavit of Ontario family court
Most written evidence in an Ontario family case goes on Form 14A. It supports a motion, answers the other side's affidavit, corrects an earlier one, or puts any other fact before the judge. Rule 14 of the Family Law Rules says what a motion needs; Form 14A is where your facts go.
The form itself is short: a court heading, the parties, your name and where you live, then blank space for numbered paragraphs, and on page 2 the jurat. Everything that matters is in the paragraphs you write. The current edition is FLR 14A dated September 1, 2005.
Writing the numbered paragraphs
The instructions printed on the form are good advice: one fact per paragraph, in a complete sentence. If you learned a fact from someone else, name that person and say you believe it to be true. A judge reads many affidavits; short paragraphs in date order are the ones that get read properly.
On this page you add the paragraphs one by one and we number them, wrap the lines and carry them over to page 2 if they need the room. The text size steps down a little for long affidavits. If the paragraphs still do not fit the two official pages, the form tells you before you book, so you can shorten them or prepare the affidavit yourself with extra pages.
The boxes around the paragraphs
| Box | What to write |
|---|---|
| Court file number | From any document the court has already issued in your case. Printed on both pages. |
| Name of court, court office address | As on your application, for example Superior Court of Justice, Family Court |
| Applicant and respondent boxes | Full legal names and addresses for service, and lawyers if there are any |
| My name is, I live in | Your full legal name, and your city and province |
| "dated" next to the form title | Left empty: it is the date the affidavit is sworn, written at the signing |
| Sworn/Affirmed before me | Completed by the commissioner on the call |
Habits that weaken an affidavit
- Argument instead of facts. Save "therefore the court should" for your submissions. The affidavit says what happened.
- Hearsay without a source. Who told you, when, and that you believe it. Without that, a judge may give the fact little weight.
- Exhibits mentioned but not attached. If a paragraph refers to an exhibit, it has to be marked and attached when the affidavit is sworn. Tell us at booking.
- A blank space at the end. The form asks you to put a line through blank space. The commissioner can do it on the call if your text ends early.
Form 14A or a more specific affidavit?
| Form | Use it for |
|---|---|
| Form 14A | Any evidence that has no form of its own: motions, replies, corrections |
| Form 35.1 | A claim for decision-making responsibility, parenting time or contact |
| Form 36 | The evidence for an uncontested divorce |
| Form 6B | Proving that you served documents on someone |
Form 35.1 itself tells you to use Form 14A for a minor correction to a parenting affidavit, so the two often appear in the same case.
Swearing Form 14A by video
Ontario Regulation 431/20 allows an affidavit to be sworn before a commissioner by video. Press Book and Sign, choose a time, add your photo ID and pay. On the call the commissioner checks your ID, you swear or affirm and sign on screen, and the commissioner completes the jurat. The commissioned affidavit is emailed to you, ready to serve and file.

FAQ
How long can my affidavit be?
As long as the two official pages hold, with up to twenty paragraphs. Longer affidavits need extra pages, which you can prepare yourself and upload when you book.
Can I attach exhibits?
Yes, but tell us when you book so the commissioner can mark them on the call.
Who fills in the date next to the title?
It is the date the affidavit is sworn, written at the signing, so it is left empty on our form.
