Where Form 36 fits in a divorce

In an Ontario divorce that nobody is contesting, the judge decides on paper. Form 36, the Affidavit for Divorce, is the sworn evidence the judge reads: who you are, that there is no chance of reconciliation, how your marriage is proven, the legal basis for the divorce and, if there are children, what arrangements were made for them.

The form belongs to the Family Law Rules and is published on the Ontario court forms site. This page uses the current edition, FLR 36 dated April 1, 2024, and prints your answers on all four of its pages.

Two answers we need, the rest is yours

Our form only insists on two things: your full legal name and the municipality and province where you live. If you already have the court file number from your issued application, add it and it is printed at the top of every page; if not, the box stays empty.

Every other paragraph is your own decision: which marriage certificate box applies, whether you were separated for a year, which paragraphs of an agreement go into the order, the children and support details. You tick and write them the way you would on paper, and the form prints exactly what you entered. We do not check the choices or calculate support.

What is on each page

PageParagraphs
1Court, file number, applicant and respondent boxes, your name and city, paragraphs 1 to 4 (application details and marriage certificate)
2Paragraphs 5 to 11: legal basis, the order you ask for, children, parenting and child support amounts
3Paragraph 11 continued: only when the support paid differs from the guidelines amount
4Paragraphs 12 and 13: costs and the respondent's last known address, then the jurat for the commissioner

Joint applications

When spouses apply together, each of them usually swears their own affidavit. On our site each person fills in their own Form 36 and books their own short video signing, so every affidavit has one deponent and one signature.

Before you swear it

  1. A missing court file number. If the court has already issued your application, its file number belongs in the box at the top of every page.
  2. Leaving paragraph 3 empty. If nothing in the application changed, the form asks you to write NONE.
  3. Ticking two certificate boxes that exclude each other. Read paragraph 4 on the preview before you book.
  4. Writing in the jurat. "Sworn/Affirmed before me" and the commissioner lines are completed at the video signing.

Swearing Form 36 by video

Book and Sign attaches the affidavit to your appointment. The commissioner checks your ID, you swear or affirm that the contents are true, sign on screen, and the commissioner completes the jurat. The commissioned affidavit is emailed to you to file with the court.
