Proof that the other side got the papers

Serving a document means delivering it in a way the Family Law Rules accept. The court then needs proof, and Form 6B is that proof: a sworn statement by the person who did the serving, saying what was served, on whom, when and how. Without it, the court may not hear your motion or may treat your application as not served.

The affidavit is sworn by the server, not necessarily by a party. In many cases a friend or relative over 18 serves the application, because a party usually cannot serve it personally. That person fills in this form and signs it with us.

Nine methods, one paragraph each

Paragraph 2 lists the ways you may have served the documents. Each one leads to its own paragraph: special service to paragraph 3, mail to 4, courier to 5, document exchange to 6 and 7, fax to 8, email to 9, substituted service or advertisement to 10. On the paper form you tick one box and strike out the paragraphs you did not use.

On our page you choose the method once and only the questions for that paragraph appear. The tick lands in the right box and the matching details are printed in the matching paragraph.

MethodWhat the form needs
Special service (paragraph 3)The place, and whether you left it with the person, a lawyer, a corporate officer, an adult at their home, or used the postcard method
Mail (paragraph 4)The address on the envelope and whose address it is
Courier (paragraph 5)Pick-up time and date, the courier's name, the address and whose address it is
Substituted service (paragraph 10)The date of the order and how you carried it out

Listing the documents

Paragraph 1 has a short table: name of each document, its author and the date it was signed, issued or sworn. Name documents the way the court does, with the form number: "Form 8: Application (General)", "Form 13.1: Financial Statement". Up to seven documents fit on the official page.

Why affidavits of service get rejected

  1. A party served the application personally. Special service of an application is usually done by someone other than the parties. The server signs Form 6B.
  2. The attachment is missing. Mail by courier needs the receipt, fax needs the confirmation, email needs a copy of the email. Attach them when you file.
  3. Several methods ticked. Tick only the method you used. Served twice in different ways? Swear two affidavits.
  4. Paragraph 11 left empty. State your relationship to the parties, or that you have none.
