Statutory Declaration — Online Notarization in Ontario

A formal statement made under the Canada Evidence Act or provincial law, used when a sworn affidavit is not strictly required but a formal declaration is.

A statutory declaration serves a similar purpose to an affidavit but is made under a different legal framework — most often the Canada Evidence Act. Government departments, financial institutions, and employers frequently ask for one when there is no legal proceeding involved, simply a fact that needs formal confirmation.

As with any document we commission, it must reach us unsigned. You sign live during the video call while the commissioner watches, verifies your photo ID, and applies the seal — this is the moment that makes the declaration valid.

Every appointment is conducted under Ontario Regulation 431/20. We commission the document as written; we do not offer legal advice on what it should say.

Statutory Declaration FAQ

What is the difference between a statutory declaration and an affidavit?

They serve a similar purpose, but a statutory declaration is made under a different statute and is not sworn on oath in the same way an affidavit is.

Can this be done fully online?

Yes, over a secure video appointment, in accordance with O. Reg. 431/20.

Do you review what the declaration says?

No, we only verify identity and witness the signature — not the contents.
