What the contractor declares

CCDC 9A is the standard declaration a general contractor gives the owner before the owner releases a second or later progress payment, or the holdback. In it, an authorized signing officer, partner or sole proprietor declares that everyone the contractor had to pay on the project (labour, subcontractors, products, services, machinery and equipment) has been paid as the contract requires, up to the last progress payment received.

Three exceptions are printed on the form and do not need explaining: holdback properly retained, payments deferred by agreement, and amounts withheld over a legitimate dispute that the other party was told about. Because the statement is a solemn declaration with the same force as an oath, it is made before a commissioner for taking affidavits, a notary public or a justice of the peace.

Progress payment or holdback?

The first thing on the page is a choice between "second and subsequent progress payments" and "release of holdback". Tick the one the owner's payment certifier or the contract calls for. The first progress payment usually needs no declaration, which is why the form starts at the second.

The box on the right ties the declaration to one payment: the number of your application for payment and the date of the last application for which you were paid. Copy both from your own payment records so the owner can match the declaration to the right certificate.

The CCDC 9 copyright seal

The bottom of the form reads "Apply a CCDC 9 copyright seal here." The seal shows the parties that the form is an accurate, unamended CCDC document, and it is the contractor's to apply under CCDC's licensing terms. Commissioning the declaration and applying the seal are separate steps; we do the first.

More about the form itself is on the CCDC page for 9A-2018.

Small slips that delay a payment

  1. Signed by someone without authority. The declarant states they are an authorized signing officer, partner or sole proprietor. A site supervisor usually is not.
  2. A trade name instead of the legal name. Use the names as they appear in the contract.
  3. Both boxes ticked, or none. One declaration covers one purpose. Our form lets you choose exactly one.
  4. Dated by the contractor. The place and date of the declaration are written by the commissioner. Pre-dating it makes it unusable.

Declaring CCDC 9A by video

After Book and Sign the form is attached to your appointment. The declarant joins the call with photo ID, confirms the contents and signs on screen, and the commissioner completes the declaration block. The signed PDF arrives by email, ready to send with your application for payment.
