Where 9B sits in the payment chain

On a construction project money flows down: the owner pays the general contractor, who pays the subcontractors, who pay their own suppliers and workers. Each level gives the level above a sworn assurance that it has paid the people below. The general contractor gives the owner a CCDC 9A; a subcontractor gives the general contractor a CCDC 9B.

The wording is the same declaration seen from one step lower. Instead of the owner and the contractor, the boxes name the contractor and the subcontractor, and "Contract" becomes "Subcontract". The general contractor often collects 9B forms from every trade before it signs its own 9A.

Holdback release on a subcontract

When the subcontract work is finished, the contractor may ask for a 9B before releasing the holdback it kept from your payments. Choose "Release of holdback" at the top of our form; the tick lands in the second box of the official page.

The declaration speaks for the whole company, not for one invoice line. If some amounts are deliberately withheld from a supplier because of a dispute that the supplier was told about, the form already allows for it in exception 3, so nothing extra needs to be written.

Common 9B mistakes

  1. Contractor and subcontractor swapped. The left box is the contractor who pays you; the right box is your company. Our form labels them so they cannot be mixed up.
  2. The 9A used by mistake. A subcontractor's declaration on a 9A names the wrong parties and is usually sent back.
  3. An unsigned officer title. The declarant writes their title; it should be a role with authority to bind the company.
  4. The declaration date filled in early. The commissioner writes where and when the declaration was made, during the call.

From form to signed PDF in one call

Book and Sign attaches the completed 9B to your appointment. On the call you show your ID, confirm the declaration and sign on screen; the commissioner completes the declaration block, and the signed 9B is emailed to you to forward to the contractor. If the contractor also needs the CCDC 9 copyright seal on it, that is applied by the party holding the seals under CCDC's terms.
