CCDC 9A and 9B: What They Are and How to Have Them Sworn Online in Ontario

Which form a contractor or subcontractor signs, what to prepare, and how to have it sworn on a video call.

On many construction projects in Ontario, a contractor or subcontractor has to hand in a sworn statement before the next payment is released. This guide explains what the CCDC 9A and 9B declarations are, which one applies to you and how to get it sworn online. It is general information, not legal advice.

What CCDC 9A and 9B are

Both are published by the Canadian Construction Documents Committee (CCDC). CCDC describes each as a sworn statement of progress payment distribution, used as a condition of receiving payment for the second and later progress payment applications, or for the release of holdback funds.

In the declaration you state, under oath, that the amounts you owe as a result of the earlier payment have been paid, with the exceptions the form itself lists, such as an amount withheld because of a legitimate dispute. Read the wording on the form before you sign.

Which form is yours

A box at the top left of the form shows which type of payment it supports: a second or later progress payment, or the release of holdback. Tick the one that applies.

Before your appointment

  • Get the form from CCDC, in the edition your contract calls for. CCDC lets you download it free of charge.
  • Complete the whole form ahead of time and check names, amounts and spelling. A commissioner cannot sign a form that is blank, only partly completed or has typing errors.
  • Leave the signature line empty. You sign live, in front of the commissioner.
  • Check the box in the lower right corner. CCDC holds the copyright, and the form has a space for a CCDC copyright validation sticker. Ask CCDC how to get one.
  • The person signing must be an authorized representative of the company. Have a valid photo ID ready.

Signing it online

Upload the completed but unsigned form when you book. You sign on a secure video call, and the declaration is commissioned in accordance with O. Reg. 431/20. We verify your identity and witness your signature. We do not review the payment figures or give legal advice.
