A sworn statement confirming that a legal document was delivered to another party, and how and when it was delivered.

Courts and tribunals need proof that the other side actually received your documents before a matter can move forward. An affidavit of service sets out who delivered the documents, to whom, on what date and in what way.

It is usually signed by the person who did the delivery: you, a friend, a family member or a process server. That person joins the video call, shows their photo ID and swears the affidavit in front of the commissioner.

Commissioned in accordance with O. Reg. 431/20. Family court matters often use Form 6B, which has its own page. We do not advise on which form or method of service your matter requires.

Who should sign the affidavit of service?

The person who actually delivered the documents.

Is this the same as Form 6B?

Form 6B is the family court version. This page covers affidavits of service used in other matters.

Can I attach proof of delivery?

Yes. Exhibits such as a courier receipt can be commissioned in the same appointment.
