A Separation Agreement sets out, in writing, how a couple will handle property, support, and parenting arrangements once they live apart. Ontario law requires it to be signed in front of two witnesses who are unrelated to either party for it to hold up as intended.

Both partners typically join the video appointment along with two independent witnesses. Each party's photo ID is verified before they sign, and the witnesses confirm the signing on camera.

Notarized in accordance with O. Reg. 431/20. We do not draft the agreement or provide legal advice on its terms — we strongly recommend each party obtain independent legal advice before signing.
